God vs. the Gavel challenges the pervasive assumption that all religious conduct deserves constitutional protection. While religious conduct provides many benefits to society, it is not always benign. The thesis of the book is that anyone who harms another person should be governed by the laws that govern everyone else - and truth be told, religion is capable of great harm. This may not sound like a radical proposition, but it has been under assault since the 1960s. The majority of (...) academics and many religious organizations would construct a fortress around religious conduct that would make it extremely difficult to prosecute child abuse by clergy, medical neglect of children by faith-healers, and other socially unacceptable behaviors. This book intends to change the course of the public debate over religion by bringing to the public's attention the tactics of religious entities to avoid the law and therefore harm others. (shrink)

The Nature of God explores a perennial problem in the philosophy of religion.

We critically examine the claim that identity is a fundamental concept. According to those putting forward this thesis, there are four related reasons that can be called upon to ground the fundamental character of identity: identity is presupposed in every conceptual system; identity is required to characterize individuality; identity cannot be defined; the intelligibility of quantification requires identity. We address each of these points and argue that none of them advances compelling reasons to hold that identity is fundamental; in fact, (...) most of the tasks that seem to require identity may be performed without identity. So, in the end, identity may not be a fundamental concept after all. (shrink)

The impact of business ethics education on socially responsible practitioner behavior is not a new concern. A sizable extant literature base questions pedagogies used and outcomes achieved by the few early studies done in this area. Ensuing research has not produced definitive answers; measurement, methodological, and generalizability issues are prevalent due to the fragmented nature of most work. Given little pre-existing structure, an empirically-based model is needed which both sheds more awareness on the ethics education-business conduct relationship and quantifies the (...) degree of change that the education caused. This study operationalizes a multi-level ethical learning model. Using a survey administered at the start and end of an MBA ethics course,subsequent exploratory factor analysis, a matched t-test of pre and post-course mean scores, and an effect size calculation utilizing the Cohen’s d statistic, the existence of varying degrees of change in ethical outlook after formal ethics education is supported. Model enhancements and the potential for longitudinally following ethical learning from the classroom to the workplace are discussed. (shrink)

How does one become an effective teacher? What can be done to stem high attrition rates among beginning teachers? While many teachers are left to ‘sink or swim’ in their first year—learning by trial and error, there remain a number of outstanding examples of collaboration and collegiality in teacher induction programs. Analysis of the most exemplary teacher induction programs from Australia, Britain, Canada, France, Germany, Japan, New Zealand and the United States revealed common attributes and exceptional features. The most successful (...) teacher induction programs reported here include opportunities for experts and neophytes to learn together in a supportive environment promoting time for collaboration, reflection and acculturation into the profession of teaching. Furthermore, several practices unique to specific regions were highlighted. These included extended internship programs, specially trained mentors, comprehensive inservice training and reduced teaching assignments for beginning teachers with an emphasis on assistance rather than assessment. Nonrelativistic quantum mechanics (QM) works perfectly well for all practical purposes. Once one admits, however, that a successful scientific theory is supposed not only to make predictions but also to tell us a story about the world in which we live, a philosophical problem emerges: in the specific case of QM, it is not possible to associate with the theory a unique scientific image of the world; there are several images. The fact that the theory may be compatible with distinct (...) ontologies, and that those ontologies may themselves be associated with a plurality of metaphysical approaches, gives rise to the problem of metaphysical underdetermination. This paper concludes that the available metametaphysical criteria fail to deliver objectivity in theory choice, and it puts forward its own criterion based on a tension between two methods of metaphysical inquiry: one that is closely related to science and another that is not. A close examination of the literature on ontology may strike one with roughly two distinct senses of this word. According to the first of them, which we shall call traditional ontology , ontology is characterized as the a priori study of various “ontological categories”. In a second sense, which may be called naturalized ontology , ontology relies on our best scientific theories and from them it tries to derive the ultimate furniture of the world. From a methodological point of view (...) these two senses of ontology are very far away. Here, we discuss a possible relationship between these senses and argue that they may be made compatible and complement each other. We also examine how logic, understood as a linguistic device dealing with the conceptual framework of a theory and its basic inference patterns must be taken into account in this kind of study. The idea guiding our proposal may be put as follows: naturalized ontology checks for the applicability of the ontological categories proposed by traditional ontology and give substantial feedback for it. The adequate expression of some of the resulting ontological frameworks may require a different logic. We conclude with a discussion of the case of orthodox quantum mechanics, arguing that this theory exemplifies the kind of relationship between the two senses of ontology. We also argue that the view proposed here may throw some light in ontological questions concerning this theory. (shrink)

Quasi-set theory is a ZFU-like axiomatic set theory, which deals with two kinds of ur-elements: M-atoms, objects like the atoms of ZFU, and m-atoms, items for which the usual identity relation is not defined. One of the motivations to advance such a theory is to deal properly with collections of items like particles in non-relativistic quantum mechanics when these are understood as being non-individuals in the sense that they may be indistinguishable although identity does not apply to them. According to (...) some authors, this is the best way to understand quantum objects. The fact that identity is not defined for m-atoms raises a technical difficulty: it seems impossible to follow the usual procedures to define the cardinal of collections involving these items. In this paper we propose a definition of finite cardinals in quasi-set theory which works for collections involving m-atoms. (shrink)

In the Incoherence of the Philosophers, Abu Hamid al-Ghazali leveled a critique against twenty propositions of the Muslim peripatetic philosophers, represented chiefly by al-Farabi and Ibn Sina. In the Fourth Discussion of this work, he rejects their claim to having proven the existence of God. The proof to which he objects is none other than the famous ‘argument from contingency.’ So why did the eminent theologian of Islamic orthodoxy reject an argument for God’s existence that ultimately became so historically influential? (...) I will show that the real targets of Ghazali’s objection are the philosophers’ doctrine of the pre-eternity of the world, and their denial of divine attributes. These two issues are linked in such a way that, only if the philosophers’ argument regarding the divine essence is sound, would they be able to prove that He exists while holding to the doctrine of the world’s pre-eternity. Scientific realism is typically associated with metaphysics. One current incarnation of such an association concerns the requirement of a metaphysical characterization of the entities one is being a realist about. This is sometimes called “Chakravartty’s Challenge”, and codifies the claim that without a metaphysical characterization, one does not have a clear picture of the realistic commitments one is engaged with. The required connection between metaphysics and science naturally raises the question of whether such a demand is appropriately fulfilled, and how (...) metaphysics engages with science in order to produce what is called “scientific metaphysics”. Here, we map some of the options available in the literature, generating a conceptual spectrum according to how each view approximates science and metaphysics. This is done with the purpose of enlightening the current debate on the possibility of epistemic warrant that science could grant to such a metaphysics, and how different positions differently address the thorny issue concerning such a warrant. On January 1, 2006, Medicare Part D prescription drug coverage was initiated. Concern was immediately voiced by the American Association of Retired Persons (AARP) and Families USA that, in response to this program, the pharmaceutical industry may raise prices for drugs most often used by the elderly. This article examines the ethical implications of a revenue-maximizing pricing strategy in an industry in which third party financing mitigates an end product's true cost to the user. The perspectives of three stakeholder groups (...) are examined: the elderly, as consumers of prescription drugs, the pharmaceutical industry, as product manufacturer and beneficiary of derived profits, and the total U. S. population, as the ultimate payer for the program via tax revenues. Key questions explored include the relationships among price strategy and access to drugs at both the micro (Medicare cohort) and macro (total population) levels, and on drug development or enhancement. The role of profit in a capitalism-based health care system is also examined. Hospital industry impact on these same stakeholder groups in response to the original 1965 Medicare law is used to compare and contrast possible outcomes of the new drug program. It is predicted that pharmaceutical firms will mimic the hospital industry, adopting a price maximizing strategy for drugs covered by the program. In the process, a utilitarian effect occurs: the benefits of increased access and diffusion of drugs counterbalance inequities in financing Medicare Part D. (shrink)

This paper introduces a four-stage ethical learning model that we posit will augment the evaluation of the effectiveness of business ethics education. Using the Ignatian (Jesuit, Catholic) methodologies of self-reflection and discernment, comments by 195 undergraduate and graduate students enrolled in an American university regarding the relationship between ethical attitudes and business conduct are examined before and after completing a business ethics course. Results suggest that ethics education can 1) raise students’ ethical awareness, and 2) shift ethical attitudes in either (...) positive or negative directions, thus supporting the existence of levels of ethical understanding that our learning model proposes. Methodological challenges for current and future evaluation of the effectiveness of ethics education, including enhancement of the generalizability of findings across international borders, are considered. Several implications for linking business ethics education with the conduct and climate of business practice are also discussed. (shrink)

In this paper we consider the notions of structure and models within the semantic approach to theories. To highlight the role of the mathematics used to build the structures which will be taken as the models of theories, we review the notion of mathematical structure and of the models of scientific theories. Then, we analyse a case-study and argue that if a certain metaphysical view of quantum objects is adopted, one seeing them as non-individuals, then there would be strong reasons (...) to ask for a different mathematical framework for describing the structures that would be the models of the corresponding theory. In departing from the standard frameworks (those worked on within standard mathematics), we hope to bring to the scene, within the scope of the semantic approach, the importance of paying attention to some fundamental concepts usually only superficially touched by philosophers of science (if touched). According to a very widespread interpretation of the metaphysical nature of quantum entities—the so-called Received View on quantum non-individuality—, quantum entities are non-individuals. Still according to this understanding, non-individuals are entities for which identity is restricted or else does not apply at all. As a consequence, it is said, such approach to quantum mechanics would require that classical logic be revised, given that it is somehow committed with the unrestricted validity of identity. In this paper we examine the arguments to (...) the inadequacy of classical logic to deal with non-individuals, as previously defined, and argue that they fail to make a good case for logical revision. In fact, classical logic may accommodate non-individuals in that specific sense too. What is more pressing for the Received View, it seems, is not a revision of logic, but rather a more adequate metaphysical characterization of non-individuals. (shrink)

This additional information specifies the microstate of \ that is incorporated into the quantum reduced action, W. Non-physical solutions of the quantum stationary Hamilton–Jacobi equation for energies that are not Hamiltonian eigenvalues are examined to establish Lipschitz continuity of the quantum reduced action and conjugate momentum. Milne quantization renders the eigenvalue J. Eigenvalues J and E mutually imply each other. Jacobi’s theorem generates (...) a microstate-dependent time parametrization \ even where energy, E, and action variable, J, are quantized eigenvalues. Substantiating examples are examined in a Hamilton–Jacobi representation including the linear harmonic oscillator numerically and the square well in closed form. Two byproducts are developed. First, the monotonic behavior of W is shown to ease numerical and analytic computations. Ontic Structural Realism is a version of realism about science according to which by positing the existence of structures, understood as basic components of reality, one can resolve central difficulties faced by standard versions of scientific realism. Structures are invoked to respond to two important challenges: one posed by the pessimist meta-induction and the other by the underdetermination of metaphysics by physics, which arises in non-relativistic quantum mechanics. We argue that difficulties in the proper understanding of what a structure is (...) undermines the realist component of the view. Given the difficulties, either realism should be dropped or additional metaphysical components not fully endorsed by science should be incorporated. (shrink)

We advance an approach to logical contexts that grounds the claim that logic is a local matter: distinct contexts require distinct logics. The approach results from a concern about context individuation, and holds that a logic may be constitutive of a context or domain of application. We add a naturalistic component: distinct domains are more than mere technical curiosities; as intuitionistic mathematics testifies, some of the distinct forms of inference in different domains are actively pursued as legitimate fields of research (...) in current mathematics, so, unless one is willing to revise the current scientific practice, generalism must go. The approach is advanced by discussing some tenets of a similar argument advanced by Shapiro, in the context of logic as models approach. In order to make our view more appealing, we reformulate a version of logic as models approach following naturalistic lines, and bring logic closer to the use of models in science. (shrink)

The double slit problem is idealized by simplifying each slit by a point source. A composite reduced action for the two correlated point sources is developed. Contours of the reduced action, trajectories and loci of transit times are developed in the region near the two point sources. The trajectory through any point in Euclidean 3-space also passes simultaneously through both point sources.

Two experiments are reported in which nondysphoric participants, not prone to excessive levels of rumination in everyday life, were asked to retrieve autobiographical memories using the Williams and Broadbent (Citation1986) procedure (AMT). In the first experiment, two variants of a self‐related category fluency task were interleaved among sets of autobiographical memory cues. In one variant (blocked) a normal model of analytic rumination was induced by grouping prompts on a single superordinate theme together. In the other (intermixed) prompts from several different (...) themes were grouped together. It was predicted that the blocked variant would reduce the number of specific memories recollected and increase the number of categoric memories relative to the intermixed variant. This prediction was confirmed and provides the first demonstration of a bidirectional causal influence of analytic rumination on the balance between specific and categoric retrievals. A second experiment showed no alteration in this balance when the same fluency manipulation involved animal‐related categories rather than self‐related ones. The results support a two component model of autobiographical retrieval being driven in part by the extent to which an analytic mode of processing is adopted in the short term and in part by the level of differentiation in self‐related schematic models. An alternative neutrino oscillation process is presented as a counterexample for which the neutrino may have nil mass consistent with the standard model. The process is developed in a quantum trajectories representation of quantum mechanics, which has a Hamilton–Jacobi foundation. This process has no need for mass differences between mass eigenstates. Flavor oscillations and \ oscillations are examined.

Quasi-truth (a.k.a. pragmatic truth or partial truth) is typically advanced as a framework accounting for incompleteness and uncertainty in the actual practices of science. Also, it is said to be useful for accommodating cases of inconsistency in science without leading to triviality. In this paper, we argue that the formalism available does not deliver all that is promised. We examine the standard account of quasi-truth in the literature, advanced by da Costa and collaborators in many places, and argue that it (...) cannot legitimately account for incompleteness in science. We shall claim that it conflates paraconsistency and paracompleteness. It also cannot properly account for inconsistencies, because no direct contradiction of the form S ∧ ¬S can be quasi-true according to the framework; contradictions simply have no place in the formalism. Finally, we advance an alternative interpretation of the formalism in terms of dealing with distinct contexts where incompatible information is dealt with. This does not save the original program, but seems to make better sense of the apparatus. (shrink)
